Like the second one as it stands but have to agree that the 1st one doesn't work due to the lack of eye contact. You can get away with the subject not looking toward you with an action shot but when the subject is static then as a general rule eye contact is required to make the viewer engage with the subject. This isn't an absolute of course as candid photography often works better when the subject is not aware of the camera or the photographer. For example...
