    I think, irrespective of what page one lands on, that the term

    Non-commercial filming / photography
    .. is likely to lead one to assume 'anything other than a commercial endeavour'. No?

    I've just had a response from a councillor together with the emails sent to him regarding it in his enquiries.

    This is the email sent to the councillor by the Head of Service for Enterprise, Tourism & Regeneration:

    "Filming and photography is the remit of the tourism unit so comes under ETR.

    I entirely agree that the wording of “non-commercial” contained within the Council’s Fees & Charges is incorrect and misleading and a better explanation of it should be “promotional”. We naturally do not inhibit anyone from taking photographs of Southend as souvenirs of their visit to the town and would certainly not charge them to do so. We do, however, charge for all promotional photography that takes place in the town. For example, we would not charge for a holiday snap taken of the Pier but would charge for, say, a charity photographing the Pier for promotional purposes. This is common practice across the country broadly speaking for the purposes of Intellectual Property Rights of, say, an asset.

    We are currently looking into amending the wording to reflect the accurate position (as it is the Council’s Fees & Charges document and not simply website literature).

    I trust this helps to resolve the situation.
