    Video filming a person without concent

    Hi Folks,

    A few days ago I employed a tree surgeon to remove a limb from a willow which was overflying my neighbors garage roof.
    The surgeon obviously rigged up ropes and slings to ensure that the limb did not fall when it became detached from the tree.
    My neighbor (the dragon lady) complained to the tree surgeon that I had not given her notice of this work.
    She then produced a video camera and proceeded to film (from her property)the whole operation.
    The tree surgeon told me that he was unhappy about the filming and did consider abandoning the job because of it.
    Did my neighbor have the right to film him without first asking him for his concent.

    I'd say yes. Your neighbour had the landowner's (i.e. her own) permission to film from her property; whatever she was filming was fair game as it was outside in plain view.

    I'd say your tree surgeon was being unduly bashful. Is he very ugly?

    Joking aside, where do all these prima donnas come from who object to a camera. They need to grow up really. I mean I can understand Brad and Angelina's concerns but a sodding tree surgeon??? Bloody hell! Maybe his agent will want 10% of his fee eh!

    She can shoot from her own property, but I suppos it might get a bit grey if she shot detail of your property from her property...?

    She does sound a bit of an arse, but I was wondering, which side of the fence was the tree surgeon on when he did the chopping? Theoretically it is your duty to chop your tree if it invades her space, as you have done, but also you should have permission if this requires you go on her property 'space' (that includes in the air).

    Obviously most people wouldnt give a flying one and as I say she does sound a bit of a tw@t, but it still might have been the polite thing to do to let her know first as she says, especially asking permission IFF it required going on her side of the fence (which Im not saying it did, as we dont know all the details).

    Hi, your impression of this elderly very sad Bovine is dead right, that's the reason I didn't inform her in the first place.
    Just for info, the tree surgeon worked entirely from inside the tree in my garden, As for damage caused to her air space, give it a few more days and you'll never notice.
    It was more her crap attitude I think, that he objected to. the filming just about put the icing on the cake.
